These Terms of Service ("Terms") govern your use of the Cardemon mobile application and the cardemon.appwebsite (together, the "Service") provided by Cardemon("Cardemon," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using the Service, you represent that you meet this requirement and that you can form a binding contract.
2. The Service
Cardemon lets you photograph Pokémon cards to receive AI-generated condition estimates, card identification, and value ranges, and to organize and share your collection. We may add, change, or remove features at any time.
3. Grades and values are estimates
All grades, sub-grades, identifications, and value ranges provided by the Service are AI-generated estimates for informational purposes only. They are not certified grades and are not guaranteed to be accurate or to match the results of any professional grading company. Cardemon is not affiliated with, endorsed by, or sponsored by PSA, BGS, SGC, The Pokémon Company, Nintendo, or any other grading service or rights holder. You are solely responsible for any buying, selling, grading-submission, or other decisions you make based on the Service.
4. Your account
You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
5. Subscriptions and payments
Cardemon offers an optional premium subscription that unlocks unlimited AI card scans and grading. Subscriptions are billed through your Apple ID and renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime in your App Store account settings. Payments, refunds, and renewals are handled by Apple in accordance with Apple's terms; we generally cannot issue refunds directly.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, infringing, or fraudulent purpose
- Upload content that is illegal, harmful, harassing, hateful, or that violates others' rights
- Attempt to reverse engineer, scrape, overload, or interfere with the Service or its security
- Misrepresent AI estimates as official or certified grades when selling or trading cards
- Resell or commercially exploit the Service without our written permission
7. User content and community
You retain ownership of the photos and content you submit. By posting to the community feed or otherwise sharing content through the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content for the purpose of operating and improving the Service. You are responsible for the content you post and must have the rights to share it. We may remove content or restrict accounts that violate these Terms.
8. Intellectual property
The Service, including its software, design, and branding, is owned by Cardemon and protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights. Pokémon and all related names, marks, and card designs are trademarks and copyrights of their respective owners; their appearance in the Service does not imply any affiliation or endorsement.
9. Third-party services
The Service relies on third parties such as Apple, Supabase, and RevenueCat. Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate will be accurate.
11. Limitation of liability
To the maximum extent permitted by law, Cardemon and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars (USD $50).
12. Indemnification
You agree to indemnify and hold Cardemon harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will continue to apply.
14. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of the United States and the state in which Cardemon operates, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located there, unless otherwise required by applicable law.
